Users under 18 make purchases together with a parent or guardian. [TO BE COMPLETED BY OWNER: Age and payment method requirements for purchases will be settled together with the payment flow.]
2. Subject of the contract
This contract sets out the rights and obligations of the parties regarding the sale and performance of paid courses, digital content and services that the buyer purchases electronically on Kuazara, in accordance with Turkey's Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
Before the purchase the buyer is shown the pre-contract information form. At the purchase step the buyer separately confirms having read and accepted it; the contract is not formed without this confirmation.
3. Main characteristics and price
The name and scope of the course or digital content (number of lessons, total length, access period), its total price (taxes included) and the payment method are shown on the purchase page and in the order summary, and form an integral part of this contract.
- Course or content name and scope: [from the order summary]
- Total price (VAT included): [from the order summary]
- Access period: [TO BE COMPLETED BY OWNER: e.g. unlimited or for the duration of a subscription]
- If a subscription: renewal period and how to cancel [TO BE COMPLETED BY OWNER]
Advertised prices are valid until updated or changed; the price of content already purchased does not change afterwards.
4. Payment
Payment is made through the payment institution named on the purchase page. [TO BE COMPLETED BY OWNER: The payment institution will be added once the payment provider is chosen.] Card details are not stored by Kuazara; they are sent directly to the payment institution.
An invoice or e-archive invoice is issued for the purchase and sent to the buyer's email address or account. [TO BE COMPLETED BY OWNER: The invoicing method will be added.]
5. Performance and access
Once payment is confirmed, the purchased content is added to the buyer's account and becomes available immediately. There is no physical delivery. The content is accessed with an up-to-date web browser and an internet connection.
If the content cannot be accessed because of a technical problem, the buyer notifies Kuazara and the problem is fixed within a reasonable time. If performance becomes impossible, the seller notifies the buyer within three days of learning this and refunds the amount collected within fourteen days at the latest.
6. Right of withdrawal and its exception
The buyer may withdraw from the contract within fourteen days of its formation without giving a reason and without paying a penalty. However, under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in electronic form or to intangible goods delivered instantly to the consumer (digital content).
Kuazara applies this exception only if, at the purchase step, the buyer uses a separate, unticked box to explicitly confirm that they want the content to be made available immediately and that they know they will therefore lose their right of withdrawal. If the buyer does not give this confirmation, the content is not made available until the withdrawal period ends, or the right of withdrawal is preserved. [TO BE COMPLETED BY OWNER: Which option applies will be settled together with the payment flow.]
How to withdraw, the refund process and any voluntary refund terms are described in the refunds and withdrawal policy.
7. Obligations of the parties
- The seller provides the content in line with the characteristics stated in the listing and the pre-contract information form.
- The buyer uses the purchased content only for their own personal learning; they do not share their account or the content with others, and do not copy, record or republish the content.
- If the content is used in breach of the Terms of use, the seller may suspend the buyer's access.
- The buyer's statutory rights regarding defective services under Law No. 6502 are reserved.
8. Personal data
Personal data processed during a purchase is processed in line with the privacy notice. [TO BE COMPLETED BY OWNER: A section on payment and invoicing data will be added to the privacy notice together with the payment infrastructure.]
9. Complaints and disputes
You can first send complaints to the seller's contact details above. In case of a dispute you may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) at your place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, or to the Consumer Court for disputes above those limits.
10. Entry into force
This contract is formed when the buyer gives electronic approval at the purchase step. A copy of the contract and the pre-contract information form is sent to the buyer's email address or account on a durable medium after the purchase. [TO BE COMPLETED BY OWNER: The delivery method will be settled together with the payment flow.]
